Terms of service

These terms are an agreement between you and Spot Downtime (“we”), which operates Spot Downtime. By creating an account or using the service you agree to them. If you use Spot Downtime for an organisation, you confirm you can accept these terms on its behalf.
1. The service
Spot Downtime checks websites, APIs, servers, DNS records and scheduled jobs that you choose, records the results, alerts you when something fails, and can publish status pages. We may improve or change features over time. If we remove a feature you pay for, we'll give you reasonable notice.
2. Accounts and workspaces
- You must give accurate information and keep your password secure. You're responsible for activity under your account.
- Workspace owners decide who joins their workspace and what role they have. Owners and admins can remove members.
- Each person may own one workspace on the Free plan. Creating extra accounts or workspaces to get around plan limits isn't allowed.
- You must be at least 18 years old to use the service.
3. Plans, billing and renewal
The Free plan costs nothing. Paid plans are billed in advance, monthly or yearly, through Razorpay, in the currency shown at checkout. Current prices are on the pricing page.
- Automatic renewal. Subscriptions renew at the end of each period until cancelled. You can cancel at any time from Plan & usage in the app.
- Cancellation. You keep paid features until the end of the period you've paid for; the workspace then moves to Free.
- Failed payments. If a renewal fails, Razorpay retries it. If it still fails, the workspace moves to Free.
- Price changes. We'll tell you before a price change applies to your subscription; it takes effect from your next renewal.
- Taxes. Any taxes that apply are shown at checkout or on your invoice.
Refunds are covered by our refund and cancellation policy.
4. Acceptable use
You agree not to:
- Monitor systems you don't own or aren't authorised to monitor.
- Use the service to attack, overload or probe systems, or to get around security controls.
- Put unlawful, harmful or misleading content on status pages, or impersonate another organisation.
- Interfere with the service, reverse engineer it, or try to access other customers' data.
- Resell the service without our written permission.
We may suspend accounts that break these rules or put the service or other customers at risk.
5. Your data
You keep ownership of the data you put into the service. You give us permission to store and process it only to provide the service to you, as described in our privacy policy. Status pages you publish are public, and you're responsible for what you choose to show on them.
6. Availability and limits of monitoring
We work to keep the service available and accurate, but we don't guarantee that it will be uninterrupted, that every outage will be detected, or that alerts will arrive within a certain time. Checks run from our servers and can be affected by network conditions between us and your systems. Use Spot Downtime alongside your own operational practices, not as your only safeguard.
7. Ending the agreement
You can stop using the service and delete your workspaces at any time. We may end or suspend your access if you seriously or repeatedly break these terms, or if we stop offering the service, in which case we'll give reasonable notice and refund any prepaid fees for the unused period.
8. Disclaimers and liability
The service is provided “as is”. To the extent the law allows, we disclaim implied warranties, including fitness for a particular purpose.
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, revenue or data, and our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.
9. Governing law
These terms are governed by the laws of India. The courts at Andhra Pradesh have exclusive jurisdiction over any dispute, subject to any rights you have under consumer protection law.
10. Changes to these terms
We may update these terms. We'll change the “Last updated” date and, for significant changes, notify account owners at least 14 days before they take effect. Continuing to use the service after that means you accept the new terms.
